Terms of use

1 · Purpose

These Terms of Use (the “Terms”) set out the terms and conditions governing the use of the opsiris.eu website and, where applicable, of the services and modules offered by the Opsiris platform (the “Platform”), as well as the rights and obligations of the parties in this respect.

Any use of the website and/or the Platform implies the user's (the “User”) full and unreserved acceptance of these Terms.

2 · Description of the service

Opsiris develops a modular digital platform intended for shipowners and fleet managers, enabling:

• real-time visibility of the technical condition of vessels;
• the anticipation and tracking of maintenance operations;
• better coordination between teams on board and teams ashore.

Access to certain modules or features of the Platform may be subject to a separate commercial agreement (quotation, licence agreement, service agreement) concluded between Opsiris and the client. In the event of any contradiction between that commercial agreement and these Terms, the terms of the commercial agreement prevail.

3 · Access to the website and the Platform

The opsiris.eu website is freely accessible to any user with Internet access. Access to the Platform (client area, modules, dashboards) is reserved for users holding credentials provided under an agreement with Opsiris.

PACIFIC uses its best efforts to ensure quality access to the website, without however being bound by an obligation of result. PACIFIC cannot be held liable for any network or server malfunction, or any other event beyond its reasonable control, that prevents or degrades access to the website or the Platform.

4 · Accounts and credentials

Each user of the Platform is responsible for keeping their login credentials confidential. Any action carried out from an account is deemed to have been carried out by the account holder, unless proven otherwise. In the event of loss, theft or unauthorised use of their credentials, the user must inform Opsiris without delay at contact@opsiris.eu.

5 · User obligations

The User undertakes to:

• use the website and the Platform in accordance with their intended purpose and with applicable regulations;
• not attempt to access data or features they are not authorised to use;
• not disrupt the proper functioning of the website or the Platform (introduction of viruses, intrusion attempts, etc.);
• provide accurate information in any contact or demonstration request.

6 · Intellectual property

See the “Intellectual property” section of the legal notice, which applies by right to these Terms. Use of the Platform grants the User no intellectual property rights over the software, algorithms, databases or content that make it up.

7 · Hyperlinks

The website may contain links to third-party sites. Opsiris exercises no control over these sites and accepts no liability for their content or their privacy policies.

8 · Changes to the Terms

Opsiris reserves the right to modify these Terms at any time, in particular to comply with any legal, regulatory, case-law or technical development. The applicable version is the one in force on the date the website is accessed.

9 · Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the courts of Marseille shall have sole jurisdiction.
